This bill creates a new DWI (driving while intoxicated) diversion program in Missouri that allows certain first-time DWI offenders to avoid a criminal conviction by participating in a court-supervised program. To be eligible, defendants must not have previous DWI convictions, cannot have a commercial driver's license, and cannot have completed a similar diversion program in the past ten years. The program can last up to 24 months and requires mandatory installation of an ignition interlock device (a breathalyzer connected to a vehicle's ignition system) for at least one year. Participants must have the device installed on any vehicle they operate and must have it serviced every 60 days. The program includes strict monitoring, with the device provider required to report any tampering, failed starts (attempts to start the vehicle while intoxicated), or missed maintenance. If the participant successfully completes all program requirements, the criminal case will be dismissed. However, if they fail to comply with the program's terms, the court can reinstate criminal proceedings. Additionally, if a participant uses the diversion program and is later charged with another DWI, they will be considered a prior offender, which typically carries more severe penalties.
