This bill establishes a new requirement for vapor product manufacturers to create a comprehensive directory of their products sold in Missouri, managed by the state's Attorney General's Office. Starting January 1, 2026, all vapor product manufacturers must annually submit a certification form under penalty of perjury, detailing each vapor product they sell in the state. The certification must demonstrate that each product either has received marketing authorization from the FDA or was marketed in the United States as of August 8, 2016, with a premarket tobacco product application submitted by September 9, 2020, that is still under review or without a final decision. Manufacturers must provide detailed information to verify their products can be legally sold and notify the Attorney General within 30 days of any material changes to their certification. By June 1, 2026, the Attorney General will create and publish a public online directory listing all certified vapor product manufacturers and their products. The bill also requires the Attorney General to provide manufacturers an opportunity to address any deficiencies before removing them from the directory, ensuring a fair process for compliance and product registration.
