This bill modifies the existing law regarding automatic stays of court and administrative proceedings for members of the General Assembly (state legislators). The bill provides that from January first to June first each year, or when the legislature is in session, members can automatically pause legal proceedings if they are subpoenaed as a witness, a party to the action, or the initial attorney for a party. The stay applies to trials, motions, hearings, depositions, and other legal proceedings, including municipal courts and jury service. However, the stay does not apply in several specific situations, such as when the member waives the protection, in workers' compensation proceedings (chapter 288), injunctive relief cases, or criminal cases involving felonies or class A misdemeanors. The bill also allows for good cause exceptions where a subpoena might be quashed or a jury service order set aside. During veto sessions, special sessions, or out-of-session committee hearings, members can request continuances of legal proceedings if they are scheduled to attend these legislative events. The Court of Appeals will have original jurisdiction over any applications to modify or terminate these stays, providing a mechanism for legal flexibility while protecting legislators' ability to fulfill their legislative duties.
