This bill creates the "Change of Venue for Capital Cases Fund" to help counties financially manage the expenses of hosting capital cases (serious criminal cases where the death penalty may be sought) that have been moved from their original county. Specifically, the bill establishes a dedicated fund in the state treasury that counties can use to seek reimbursement for juror sequestration costs when a capital case is transferred to their jurisdiction. Counties must apply for reimbursement by May 1st each fiscal year, with disbursements made by June 30th. If the total reimbursement claims exceed the available funds, claims will be paid on a pro-rata basis. The reimbursement is limited to state-approved rates for travel, lodging, and meals. If the reimbursed amount is less than the actual costs, the original county must cover the difference. The office of state courts administrator will manage the fund and develop the application and eligibility procedures. The bill ensures that any unspent funds in the account will not revert to the general revenue fund and that any investment earnings will be credited back to the fund.
