This bill modifies the rules for impact assistance payments for large industrial facilities in Wyoming. Currently, impact assistance payments are capped at different percentages based on the total estimated materials costs of a facility, ranging from 2.25% for facilities costing $350 million or less to 1.5% for facilities costing $850 million or more. The bill introduces a new mechanism allowing the Industrial Siting Council to increase the maximum allowable percentage to up to 2.76% for facilities with materials costs exceeding $350 million. To do this, the council must first provide specific findings that the standard maximum percentage is insufficient to mitigate identified impacts. The proposed increase must then be reviewed by the State Loan and Investment Board, which can approve, deny, or modify the proposed percentage increase. The board's decision is final and not subject to further review by the Industrial Siting Council. The bill also requires the council to submit a report to legislative committees whenever it increases the maximum percentage and mandates that affected counties, cities, and towns provide annual reports on how they used the impact assistance payments. The changes will apply only to industrial facility permit applications submitted on or after July 1, 2025.
