This bill addresses deceptive solicitation practices by establishing clear requirements for written solicitations that could be mistaken for bills or invoices. The legislation requires that any written solicitation that might reasonably be interpreted as a bill must include a prominent disclaimer stating "THIS IS NOT A BILL. THIS IS A SOLICITATION. YOU ARE UNDER NO OBLIGATION TO PAY THE AMOUNT STATED ABOVE UNLESS YOU ACCEPT THIS OFFER." This disclaimer must be in boldface capital letters, at least 30-point font, and in a color that prominently contrasts with the background. The notice must be placed conspicuously below any portion of the document that appears to specify a monetary amount due, and it cannot be obscured or diminished by other text or formatting. The bill applies to multi-page solicitations, requiring the disclaimer on each page that could be mistaken for a bill. If a person is damaged by a violation of these requirements, they are entitled to damages equal to three times the sum solicited, providing a significant deterrent to misleading solicitation practices.
