This bill adds a new section to South Carolina law that provides clear guidelines for recreational vehicle (RV) park operators regarding the removal of guests under specific circumstances. The law outlines five primary reasons an operator can request a guest to leave: illegal drug possession or dealing, disturbing other guests, causing damage to the park, violating posted park rules, or failing to pay agreed-upon rent. The bill emphasizes that guest removal cannot be based on race, color, national origin, sex, physical disability, or creed. When removing a guest, the operator must provide a written notice requesting immediate departure, and if the guest has prepaid, they must receive a refund for unused time. Guests who refuse to leave after receiving such notice commit a misdemeanor, punishable by a fine up to $300 or up to 30 days in jail. The law also allows park operators to disconnect utilities for guests with outstanding accounts exceeding three nights' rent and permits them to call law enforcement to assist with removing guests who are illegally present or violating park rules. Additionally, the bill allows for additional ejection grounds to be established in written lease agreements between park operators and guests. The law will take effect upon the Governor's approval.
