AI Summary
This bill requires all public higher education institutions in South Carolina to implement a strict policy prohibiting students, faculty, and staff holding nonimmigrant visas (specifically F-1, M-1, and J-1 visas) from publicly supporting terrorist activities or organizations related to ongoing conflicts. The policy mandates immediate investigation and enforcement upon receiving credible allegations, with a "preponderance of evidence" standard for determining guilt. First-time violations result in at least a one-year suspension for students or employment termination, while second-time violations lead to permanent expulsion or termination. Institutions must also update the Department of Homeland Security's Student Exchange Visitor Information System (SEVIS) to reflect these actions and are prohibited from allowing individuals previously suspended or expelled from another institution to transfer, enroll, or be employed. The bill empowers the Attorney General or other state officials to compel institutions to enforce this policy, with potential fines ranging from $10,000 to $100,000 for non-compliance. The law is set to take effect on July 1, 2026, and includes a severability clause to ensure that if any part of the act is found unconstitutional, the remaining provisions will remain valid.
