AI Summary
This bill establishes the "Healthy Rental Housing Act" to address mold issues in residential rental properties in South Carolina. The legislation introduces several key provisions: First, it defines new terms like "visible evidence of mold" and "mold remediation in accordance with professional standards" to provide clear guidelines for landlords and tenants. Second, it requires landlords to disclose any visible mold in a dwelling unit during move-in and gives tenants options to terminate the lease or request mold remediation if mold is present. Third, it mandates that landlords maintain rental properties in a condition that prevents moisture accumulation and mold growth, and promptly respond to mold-related issues. Correspondingly, tenants are required to use reasonable efforts to prevent moisture and mold and notify landlords of any such problems. In cases where mold materially affects health or safety, the bill allows landlords to require tenants to temporarily vacate the unit for up to 30 days while remediation occurs, during which the landlord must provide a comparable dwelling or hotel room at no cost to the tenant. The landlord is responsible for mold remediation costs unless the mold results from the tenant's failure to maintain the property appropriately. The bill aims to protect tenants' health and establish clear responsibilities for both landlords and tenants regarding mold prevention and remediation.
