This bill amends South Carolina state law regarding the licensing of tattoo facilities by modifying existing restrictions on their locations. Currently, tattoo facilities face limitations on proximity to churches, schools, and playgrounds. The bill now allows the state department to issue a license for a tattoo facility if all nearby churches, schools, and playgrounds within the specified parameters provide an affirmative statement that they do not object to the license. To obtain the license, an applicant must gather written statements from the decision-making bodies of each nearby institution: for churches, this means the local church leadership; for playgrounds, the owner's decision-making body; and for schools, the local school district board, charter school governing board, or private school governing authority. If multiple churches, schools, or playgrounds are within the parameters, statements must be obtained from all of them. Additionally, during license renewal periods, schools retain the right to withdraw their non-objection by notifying the department. The bill grants the department authority to create regulations for implementing these new provisions, and it will take effect upon the Governor's approval.
