This bill mandates the installation and use of video recording equipment in day-care centers that provide care for children two years of age or younger. The bill requires centers to place video recording equipment in all areas occupied by children in this age group and record these areas whenever such children are present. Day-care centers connected to schools or other facilities only need to record classroom areas. The video recording must visually monitor all areas where young children are present, with specific exceptions for bathrooms and changing areas to protect children's privacy. Centers must retain recorded video for at least 30 days, and in cases of an alleged incident, must keep the video until the matter is fully resolved. Access to these recordings is strictly limited and confidential, with viewing permitted only by involved employees, parents of children in an alleged incident, and authorized personnel conducting investigations or monitoring inspections. The bill provides a grace period, noting that day-care centers are not required to implement this video recording system until January 1, 2026, and the act will take effect on September 1, 2025. The executive commissioner is authorized to adopt rules for implementing this new requirement.
