AI Summary

This bill introduces a new criminal offense of reckless endangerment in South Carolina, creating two distinct degrees of the crime. First-degree reckless endangerment occurs when a person engages in conduct that creates a substantial risk of death or bodily injury to another, specifically involving a deadly weapon, unlawful firearm discharge, or a prior conviction of certain offenses. Second-degree reckless endangerment is a broader misdemeanor that involves creating a substantial risk of death or bodily injury, punishable by up to three years in prison or a fine at the court's discretion. The bill also amends existing laws to include reckless endangerment in provisions related to weapons offenses and bond requirements. Specifically, if someone commits reckless endangerment while already out on bond for a previous violent or firearm-related offense, their original bond will be revoked, and a circuit court hearing must be held within 30 days to determine bond conditions. The bill defines key terms like "deadly weapon" (any instrument that can inflict deadly force) and "bodily injury" (causing a substantial risk of death or physical impairment). The legislation will take effect upon the Governor's approval, aiming to enhance public safety by creating stricter penalties for dangerous behavior.
