Bill Summary

AN ACT ENTITLED: “AN ACT REVISING LAWS RELATED TO JUDICIAL TRANSPARENCY IN JUDICIAL ELECTIONS; ALLOWING JUDICIAL CANDIDATES TO INDICATE A POLITICAL PARTY AFFILIATION ON A DECLARATION FOR NOMINATION AND TO HAVE THAT AFFILIATION APPEAR ON THE BALLOT; ALLOWING JUDICIAL CANDIDATES TO ANNOUNCE POLITICAL PARTY AFFILIATIONS ANDORSEMENTS; AMING SECTIONS 13-10-209, 13-10-602, 13-12-203, 13-14-112, AND 13-14- 115, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.”

AI Summary

This bill revises Montana's election laws to allow judicial candidates to indicate their political party affiliation on nomination declarations and ballots, a significant change from previous restrictions on party identification for judicial races. Specifically, the bill permits judicial candidates to voluntarily state their political party affiliation when filing for office, have that affiliation printed on the ballot (in no more than three words), and make campaign announcements about party endorsements. If a judicial candidate chooses not to indicate a party affiliation, their ballot entry will be marked as "Undisclosed". The legislation aims to provide voters with additional information about judicial candidates by allowing more transparency regarding potential political leanings, while maintaining the option for candidates to remain nonpartisan if they prefer. The bill amends several sections of Montana's election code to implement these changes and will become effective immediately upon passage and approval.
