This bill modifies Montana's mining regulations to introduce a new category called "minor maintenance items" for permit violations at mines. Under this legislation, when a minor maintenance item is identified during an inspection, the director or an authorized representative will issue a correction letter giving the mine operator 14 days to address the issue. A minor maintenance item is defined as a permit violation that does not create an imminent danger to public health or safety, is not expected to cause significant environmental harm, can be reasonably corrected within 14 days, does not require a cessation order or public hearing, and occurs within the permit boundary. If the operator fails to correct the item within 14 days or by the next regular inspection, the director can then issue a notice of noncompliance or an order of cessation. The bill also updates related sections of law to reference this new process, including adjusting penalty calculation and hearing procedures. Additionally, the bill includes provisions that make the law contingent on approval by the U.S. Secretary of the Interior and provides for immediate effectiveness upon passage.
