Bill Summary

AN ACT ENTITLED: “AN ACT REQUIRING THE DEPARTMENT OF JUSTICE, THE DEPARTMENT OF CORRECTIONS, AND THE JUDICIAL BRANCH TO CONFER AND DETERMINE THE BEST WAY TO PROVIDE CRIMINAL HISTORY INFORMATION TO THE CRIMINAL JUSTICE DATA WAREHOUSE; PROVIDING THAT, IF A CONSENSUS IS NOT REACHED, THE DEPARTMENT OF CORRECTIONS BE REQUIRED TO PROVIDE CRIMINAL HISTORY INFORMATION TO THE CRIMINAL JUSTICE DATA WAREHOUSE; PROVIDING AN APPROPRIATION; AND AMING SECTION 44-7-126, MCA.”

AI Summary

This bill modifies existing law to improve the criminal justice data warehouse, which is a centralized system for storing and sharing criminal justice information. Specifically, the bill requires the Department of Justice, Department of Corrections, and Judicial Branch to collaborate by October 1, 2025, to determine the most efficient method of providing criminal history information for offenders convicted in district court over the past 5 fiscal years and for future convictions. The criminal history information must include a way to identify each convicted offender. If these three agencies cannot reach a consensus by the specified date, the Department of Corrections will be responsible for providing the criminal history information to the data warehouse. The bill also includes a small appropriation of $2,000 each to the Department of Corrections, Department of Justice, and Judicial Branch to support this collaborative effort. The underlying purpose is to enhance data-sharing capabilities among criminal justice entities, helping state and local officials make more informed decisions about the criminal justice system while maintaining data confidentiality and ownership.
