This bill modifies the requirements for "exempt surplus land" related to sectional planning areas, specifically focusing on land dedicated prior to January 1, 2019. The bill changes the affordable housing requirements so that a minimum of either 25% of the proposed units (excluding units designated for students, faculty, or staff of an academic institution) or 500 units, whichever is greater, must be dedicated to lower income households. These affordable housing units must be subject to deed restrictions for 55 years for rental units and 45 years for owner-occupied units. Additionally, the land must be developed at an average density of at least 10 units per acre, calculated across the entire sectional planning area and including housing for students, faculty, and staff. The bill also introduces specific requirements for student housing units to be counted toward the density calculation, such as having a fully functioning kitchen and meeting certain occupancy and infrastructure standards. Importantly, the bill limits the issuance of certificates of occupancy for non-residential square footage relative to residential square footage to ensure balanced development. The provision is set to become inoperative on January 1, 2034.
