This bill establishes new consumer rights regarding product repair by requiring manufacturers to provide diagnostic and repair information and service parts to product owners and independent repair providers. The legislation defines key terms such as "authorized repair provider" (a business with a manufacturer's license to offer repair services), "independent repair provider" (a repair business not affiliated with the manufacturer), and "product" (any item excluding motor vehicles). Owners and independent repair providers will now have the right to access the same diagnostic and repair information that manufacturers provide to their authorized repair providers, including technical updates, diagnostic software, service access passwords, and firmware updates. They can also purchase service parts at fair and reasonable terms. The bill includes provisions to protect manufacturers' trade secrets and does not require manufacturers to provide information for products under valid warranty. Manufacturers must provide information in a standardized format and cannot exclude security-related diagnostic information. If a manufacturer fails to comply, an independent repair provider or owner can notify the manufacturer and potentially file a complaint in circuit court. Violations of the bill will be enforced by the attorney general and result in a $500 fine, which will be deposited into the county school fund.
