Bill Summary
Storm water management. Provides that a unit does not have the power to adopt a law, rule, ordinance, or regulation that is more stringent than or exceeds in any manner the requirements of the department of environmental management's (IDEM) construction stormwater general permit (CSGP). Provides that if a law, rule, ordinance, or regulation is more stringent than or exceeds the CSGP, then: (1) the law, rule, ordinance, or regulation is void; and (2) the unit must continue to discharge its duties under IDEM's CSGP program. Provides that a unit or IDEM may under certain circumstances: (1) issue a written warning to a person engaging in land disturbing activities; and (2) issue a stop work order for the site. Makes conforming changes.
AI Summary
This bill establishes new regulations for storm water management at the local government level, primarily restricting local units from creating storm water rules that are more stringent than the Indiana Department of Environmental Management's (IDEM) construction stormwater general permit (CSGP). The bill defines "land disturbing activity" as any human-made change to land surface, such as removing vegetation, excavating, filling, or grading. Under the bill, local governments cannot adopt laws, rules, ordinances, or regulations that go beyond IDEM's CSGP requirements, and if they do, such regulations will be automatically void. For land disturbing activities involving less than one acre that are not part of a larger development plan, local units or IDEM may issue a written warning if sediment or dust is not controlled, and if corrective action is not taken within 48 hours, they can issue a stop work order. The bill appears designed to standardize storm water management regulations across Indiana, preventing local governments from imposing stricter standards than the state's baseline permit requirements, with the aim of potentially reducing regulatory complexity and compliance costs for developers.
