This bill provides the Wyoming Secretary of State with expanded administrative authority to cancel trademark, service mark, and trade name registrations under specific circumstances. The new provisions allow the Secretary to cancel a registration if they determine it is in the public interest and the registrant has provided fraudulent information or failed to correct false information when requested. If the Secretary decides to cancel a registration, they must first send a written notice to the registrant by certified mail explaining the grounds for cancellation. The registrant then has 60 days to respond and demonstrate why the cancellation should not occur. If the registrant's response is unsatisfactory or no response is received, the Secretary can proceed with cancellation and must send a written notice of cancellation. The registrant retains the right to appeal the cancellation to a chancery or district court within 30 days of receiving the cancellation notice, with the court having the power to reinstate the registration or take other appropriate actions. The bill amends two existing statutes (W.S. 40-1-108 and 40-2-107) to implement these new procedures and will become effective on July 1, 2025.
