This bill creates a new chapter in the Texas Property Code that allows for easier amendment of restrictions in specific multi-zoned subdivisions. The bill applies to subdivisions platted before 1965 with over 900 lots located in multiple municipalities, specifically targeting subdivisions in municipalities with at least 30,000 residents and spanning at least three counties. To amend existing restrictions, property owners must obtain approval from at least 67 percent of lot owners in the designated area through a written ballot that details the proposed amendment. The ballot must be mailed to property owners using appraisal district records and must be recorded in the county's real property records before the vote. If the amendment passes, a certification document must be recorded in the county records, and the amendment becomes legally binding. Importantly, the bill prevents lot owners from challenging the amendment's validity on grounds of incomplete coverage across the entire subdivision. The legislation applies retroactively to restrictive covenants enacted before, on, or after the bill's effective date, which will be either immediately upon receiving a two-thirds legislative vote or September 1, 2025, if immediate approval is not achieved.
