This bill amends the environmental conservation law to prohibit passenger vehicles from idling for more than three consecutive minutes, with several specific exceptions. The bill defines a passenger vehicle as a motor vehicle, light-duty truck, or other non-commercial personal transportation vehicle, excluding electric vehicles. Exceptions to the idling restriction include situations involving traffic conditions, regulatory temperature requirements, hybrid-electric vehicle battery charging, temperatures at or below 32 degrees Fahrenheit, vehicle maintenance, safe loading or unloading of people with disabilities, vehicles containing children or pets, and military tactical vehicles during training. Emergency vehicles are entirely exempt from this regulation. For enforcement, the first violation results in a warning, and subsequent violations are considered traffic infractions punishable by a $150 fine. The bill does not preempt local laws that may have more stringent anti-idling regulations, such as existing rules in New York City. The legislation will take effect 180 days after becoming law, providing time for public education and preparation for the new restrictions.
