This bill modifies the Bay Restoration Fund's septic system upgrade program by changing the priority order for funding failing sewage systems. The new priority hierarchy is: first, systems in the Chesapeake and Atlantic Coastal Bays Critical Area; second, systems within Maryland Chesapeake Bay watersheds with a total nitrogen reduction effectiveness of 9.24 or higher according to the Chesapeake Bay watershed model; third, systems located within the 500-year floodplain; and fourth, other failing systems that pose a threat to public health or water quality. The bill also expands funding eligibility criteria for on-site and community sewage systems, including provisions for low- and moderate-income homeowners to receive financial assistance for system upgrades, replacements, and maintenance. Additionally, the bill updates language around funding allocation, technical support, and the conditions under which community sewerage systems or connections to municipal wastewater facilities can be funded. The changes aim to more strategically target funding to improve water quality and address environmental concerns in Maryland's sensitive bay and watershed areas. The bill is set to take effect on July 1, 2026.
