This bill reforms the collective bargaining process for state employees by establishing a more structured arbitration framework. It requires that for most state employee bargaining units, if negotiations have not concluded by September 1, the parties must select a neutral arbitrator from a list of qualified nationwide arbitrators. The arbitrator can mediate disputes, receive information requests, and issue advisory opinions. If negotiations reach an impasse after October 1, a formal arbitration process is triggered where each party submits a last, best, and final offer, and the arbitrator must select one offer in its entirety. The arbitrator must consider factors like the state's financial ability, economic conditions, and comparisons with other public employment when making a decision. The bill also proposes a constitutional amendment requiring that each state budget include appropriations necessary to implement the terms of memoranda of understanding for state employees, whether reached through mutual agreement or binding arbitration. The constitutional amendment would be placed on the ballot in the November 2026 general election for voter approval. If approved, the changes to the collective bargaining process would take effect upon the governor's proclamation of the amendment's adoption.
