This bill amends Maryland's building performance standards to require new buildings to meet all energy demands without using fossil fuels, with a phased implementation approach. Starting January 1, 2026, buildings under seven stories tall must meet this requirement by October 1, 2027, while buildings seven stories or taller must comply by October 1, 2031. Local jurisdictions can grant waivers for specific types of buildings or systems, such as emergency backup power, commercial food establishments, laboratories, laundromats, hospitals, and crematoriums, but these waivers must be limited to building systems that cannot feasibly use non-fossil fuel energy sources. The bill also requires waived buildings to minimize emissions, maximize safety, and comply with new electric-ready standards. Additionally, the Maryland Department of Labor must report by December 1, 2026, on potential policy changes to ensure these new standards do not negatively impact housing affordability or electricity costs. The law will take effect on October 1, 2025, giving stakeholders time to prepare for the new energy requirements.
