This bill creates a new criminal offense related to fraudulent possession of residential real property. Specifically, it makes it illegal for a person to possess or claim possession of residential real property they do not lawfully own or possess, with the intent to defraud another person. The bill establishes a graduated penalty system for violations: a first offense can result in up to 90 days in jail or a $500 fine, a second offense within two years can lead to up to 6 months in jail or a $1,000 fine, and subsequent offenses within two years can result in up to 1 year in jail or a $2,500 fine. The law includes important exceptions, such as when a person has been granted possession through a court order or when other legal remedies are available. Additionally, the bill allows property owners to submit a sworn affidavit to the local sheriff alleging fraudulent possession, which may result in the removal of the unauthorized occupant, unless the occupant can provide evidence of lawful possession. The law does not prevent property owners from pursuing additional legal action through existing real property statutes. The bill is set to take effect on October 1, 2025.
