The bill removes language that previously allowed commissioners to deem telehealth services for mental health, developmental disabilities, and addiction services as appropriate, instead stating that such services will be reimbursed at in-person rates unless a specific service is deemed inappropriate by the relevant commissioner. The bill also maintains that telehealth providers cannot be reimbursed for facility fees or clinic-related costs if those costs were not actually incurred during telehealth service delivery. Additionally, reimbursement for additional telehealth modalities, provider categories, and originating sites, as well as audio-only telephone communications, will remain contingent on federal financial participation. The bill will take effect 60 days after becoming law, with the understanding that these amendments do not change the eventual expiration of the underlying legal provision.
