Bill Summary

Expulsion and suspension. Provides that a student may be suspended or expelled only upon: (1) a determination that the student's suspension or expulsion will prevent or substantially reduce the risk of interference with an educational function or school purposes, disruption of the school learning environment, or physical injury to the student, other students, school employees, or school visitors; and (2) in the case of an expulsion, a determination that all other available and appropriate disciplinary and behavioral interventions have been exhausted. Provides that notice to a parent of: (1) a student's suspension or expulsion must include the rationale for the length of the suspension or expulsion; and (2) the right to appear at an expulsion meeting must include the behavioral and disciplinary interventions attempted, if any, and the rationale for the length of the expulsion. Provides that if a student is suspended, the student must be provided: (1) appropriate and available support services, as determined by the school, during the suspension period; and (2) an opportunity to receive credit for completion of make up work.

AI Summary

This bill modifies Indiana's school disciplinary policies by introducing more stringent and nuanced guidelines for student suspensions and expulsions. The legislation requires that suspensions and expulsions can only occur when school administrators determine that such actions will substantially reduce risks to educational functions, school environment, or physical safety. For suspensions, the principal must specifically assess whether removing a student will prevent interference with school purposes, disrupt the learning environment, or reduce potential physical harm. For expulsions, the superintendent must first exhaust all other available disciplinary and behavioral interventions before proceeding. The bill also enhances parental notification requirements, mandating that parents receive detailed rationales for suspension or expulsion lengths and information about attempted interventions. Additionally, the legislation ensures that suspended students receive support services during their suspension and opportunities to complete make-up work, maintaining their academic progress. The bill applies to various scenarios including student misconduct, substantial disobedience, and unlawful activities both on and off school grounds, with specific provisions for serious infractions like bringing firearms or weapons to school. These changes aim to create a more measured and supportive approach to student discipline, balancing school safety with students' educational continuity.
