This bill establishes a new legal framework in Indiana for the expedited removal of squatters from residential properties. To remove a squatter, the property owner must complete a detailed affidavit affirming their ownership and the unauthorized nature of the occupancy, which includes 12 specific declarations such as having directed the person to leave, confirming the person is not a tenant or family member, and understanding potential legal consequences for false statements. Once the law enforcement agency verifies the affidavit, they are required to serve a notice to the squatter to immediately vacate the property and can assist the property owner in changing locks or removing the squatter's personal belongings. Law enforcement officers may also arrest the squatter if there is probable cause of an offense. The bill provides protections for law enforcement and property owners from liability for property loss or damage during removal, and it allows individuals who believe they were wrongfully removed to seek legal remedies. Importantly, this new process is meant to supplement existing legal methods for property possession and is designed to provide a faster, more streamlined approach to removing unauthorized occupants from residential properties.
