Bill Summary

AN ACT to amend the labor law, in relation to workplace mental health

AI Summary

This bill directs the New York State Commissioner of Labor, in consultation with the Commissioner of Mental Health and the Division of Human Rights, to develop and distribute workplace mental health awareness materials. These materials must include information about mental health signs and symptoms, resources like hotlines and websites, and details about anti-discrimination laws for employees with mental health-related disabilities. The materials will be translated into the twelve most common non-English languages in the state. Employers will be required to post these materials in a visually conspicuous and accessible location, and if a significant number of employees primarily speak a translated language, the materials must be posted in both English and that language. Additionally, the bill mandates the creation of voluntary guidance for employers to help them reduce mental health stigma, increase awareness of mental health concerns, create inclusive workplace environments, and promote mental health wellness and stress management. These resources will be available in both written and digital formats for employers to use at their discretion. The bill will take effect 180 days after becoming law.
