This bill amends Indiana law to establish a new emergency short-term placement option for endangered adults who are experiencing life-threatening emergencies and cannot safely return to their previous location. The Division of Aging, in consultation with the Prosecuting Attorneys Council of Indiana, is required to create this placement option for adults who need protective services but cannot or do not consent to standard services. The bill allows the adult protective services unit to petition a court for an emergency protective order that can include this short-term placement if the court determines the individual is an endangered adult facing a life-threatening emergency. The emergency protective order can last up to 10 days, or potentially 30 days if an extraordinary need is demonstrated, and must specify the objectives, least restrictive services needed, and duration of protective services. The goal is to provide a temporary safe setting for vulnerable adults who are at immediate risk, with the order allowing for the provision of emergency services and potential placement in a setting identified by the Division of Aging as appropriate for short-term care.
