Bill Summary

Access to employee restrooms. Provides that if a retail establishment has a restroom facility on its premises for the use of the retail establishment's employees, a customer who suffers from an eligible medical condition must, upon request, be allowed to use the restroom facility during normal business hours if certain conditions are met. Specifies that a customer who uses the retail establishment's employee restroom facility is responsible for leaving the restroom facility in the same condition as when the customer entered the restroom facility. Provides immunity from civil liability for any act or omission in allowing a customer to use an employee restroom facility if all of the specified conditions for use of the facility are met, provided that the act or omission: (1) is not willful or grossly negligent; and (2) occurs in an area of the retail establishment that is not accessible to the public. Imposes a maximum $100 civil penalty on an owner, operator, or employee of a retail establishment for violating these provisions.

AI Summary

This bill establishes new regulations for customer access to employee restrooms in retail establishments, specifically for individuals with certain medical conditions. The bill defines a "customer" as someone lawfully on the premises, and an "eligible medical condition" as Crohn's disease, inflammatory bowel disease, or ulcerative colitis. Under the new law, if a retail establishment has an employee restroom, they must allow a customer with a qualifying medical condition to use it during business hours, provided several conditions are met: the restroom is safe, the customer has written medical certification or uses an ostomy device, at least two employees are working, access does not create health or safety risks, the establishment does not normally make restrooms public, and no public restroom is immediately available. The customer must leave the restroom in the same condition they found it. The bill provides civil liability protection for retail establishments that allow access under these conditions, and imposes a maximum $100 civil penalty for violations. Importantly, the law does not require any physical modifications to existing employee restrooms and is set to take effect on July 1, 2025, offering a compassionate solution for individuals with specific medical needs.
