Bill Summary

Protective orders and employment. Provides that an employer may not discriminate against an employee with respect to compensation and benefits from the employer or terms and conditions of employment based on: (1) the employee's filing of a petition for a protective order, whether or not the protective order has been issued; or (2) the actions of an individual against whom the employee has filed a protective order.

AI Summary

This bill amends Indiana employment law to provide stronger protections for employees who have filed a protective order. Specifically, the bill prohibits employers from discriminating against employees in terms of compensation, benefits, or employment conditions based on either (1) an employee filing a petition for a protective order, regardless of whether the order is ultimately issued, or (2) the actions of the individual against whom the protective order was filed. While the bill maintains an existing provision that prevents employee termination under these circumstances, it expands the anti-discrimination protections to cover a broader range of employment actions. The bill also adds a new section clarifying that these protections do not limit an employee's rights or remedies under other federal or state laws. Importantly, the bill includes an exception allowing employers and employees to mutually agree to alter employment terms. The legislation is set to take effect on July 1, 2025, and appears designed to provide additional job security for individuals seeking legal protection from potential harassment or threats.
