This bill creates a new section in North Dakota's Century Code that gives the state's public utilities commission (the commission) broader discretion to exempt electric public utilities from certain regulations affecting rates, contracts, services, facility adequacy, and utility rules. Specifically, the commission can grant an exemption if it determines that doing so serves the "public interest," which allows for significant regulatory flexibility. The commission can attach specific terms and conditions to any exemption it grants and retains the ability to revoke or suspend the exemption according to existing administrative procedures. Importantly, this new provision does not diminish the commission's existing regulatory authority under other chapters of state law.
