When a covered person (a public official or candidate) notifies an AI system's owner that they do not want realistic depictions of themselves generated, the owner must develop a method to block such creation within 60 days. The bill establishes a liability framework where AI system owners can be fined up to $100 per unauthorized depiction, with a maximum aggregate fine of $100,000, if they fail to implement reasonable preventive measures. However, they would not be liable if the unauthorized depictions are incidental or unforeseeable, or if they have implemented reasonable safeguards. The bill provides exceptions for systems where AI outputs are processed by third parties with no control over the underlying generative model, and it will take effect one year after becoming law.
