This bill prohibits the sale, lease, and distribution of infant walkers in New York State and restricts their use in child care facilities. The bill defines an infant walker as a mobile unit with a seated area and wheeled base that allows a child to move while seated or standing. Under the proposed law, no manufacturer, importer, distributor, wholesaler, retailer, or secondhand dealer can sell or lease infant walkers in the state. In child care facilities, infant walkers are banned unless a medical professional determines that a specific child requires the walker for medical necessity. The Office of Children and Family Services must notify child care facilities about this restriction and develop implementing regulations. Violations of the sales prohibition can result in legal action by the Attorney General, including injunctions and civil penalties up to $500 per violation. Each sale of an infant walker would constitute a separate violation. The bill aims to prevent potential injuries associated with infant walkers and will take effect 90 days after becoming law. The legislation includes a severability clause, meaning that if any part of the law is found unconstitutional, the remaining provisions can still be enforced.
