This bill amends New York's public health law to include oral nicotine pouches in existing regulations concerning tobacco and nicotine products. Specifically, the bill defines a "nicotine pouch" as a smokeless, pre-portioned pouch containing nicotine (but no tobacco) that users place between their lip and gum to release nicotine and taste. The legislation expands previous restrictions on tobacco and vapor products to also cover nicotine pouches, including prohibitions on free distribution, sales to individuals under 21, and the sale of flavored products. The bill defines "flavored" products as those with a distinguishable taste or aroma other than tobacco, which would include nicotine pouches with fruit, chocolate, mint, or other flavors. Retailers who sell flavored nicotine pouches could face civil penalties of up to $100 per package, with some exceptions for products authorized by the U.S. Food and Drug Administration. The law will take effect 90 days after it becomes law, giving retailers and manufacturers time to adjust to the new regulations.
