This bill amends Indiana insurance law to establish new requirements for insurers when using aerial photography to determine whether to renew property insurance coverage. The bill defines key terms like "aerial image" (a property photo taken from an airborne platform) and "risk scoring system" (a method insurers use to assess claim likelihood). When an insurer decides not to renew a property insurance policy based on aerial images, they must now include specific information in the nonrenewal notice, such as date-stamped aerial images showing property conditions that do not meet underwriting guidelines, an explanation of how the property owner can reverse the nonrenewal decision, and disclosure of the risk scoring criteria used. The insurer must also create a process for property owners to provide documentation demonstrating that previously identified property condition issues have been resolved, establish an appeal process for challenging the property's risk score, and provide at least 60 days for the property owner to cure any identified conditions. If the property owner successfully demonstrates that conditions have been addressed, the insurer must offer to renew the policy. The bill is set to take effect on July 1, 2025, and requires the state insurance department to develop rules to implement these new requirements.
