This bill establishes two new criminal offenses under New York State law: voyeurism in the second degree and voyeurism in the first degree. Voyeurism in the second degree occurs when a person trespasses to view another person in a situation where they have a reasonable expectation of privacy, without their knowledge or consent, for purposes such as sexual arousal, amusement, entertainment, profit, or to degrade or abuse the victim. This can include viewing someone dressing, undressing, or their intimate body parts, or observing someone engaging in sexual conduct. The offense is classified as a class B misdemeanor. Voyeurism in the first degree is charged when a person commits voyeurism in the second degree and has a prior conviction for voyeurism within the past ten years, which is classified as a class A misdemeanor. The bill also modifies existing law to include these new offenses in exceptions for certain professionals like law enforcement, firefighters, healthcare workers, and correctional facility personnel when performing their authorized duties, and for certain security surveillance situations where notice is provided or the surveillance is clearly visible.
