This bill establishes a streamlined process for approving new academic programs at not-for-profit colleges and universities in New York State, provided these programs do not require major changes to their charters or lead to professional licenses. Under this new law, if a program is approved by the institution's governing body and meets specific criteria regarding its history, accreditation by recognized agencies like the Middle States Commission on Higher Education, or qualifies as a "highly qualified out of state institution" that merges with a New York institution, it will be considered registered with the Department of Education within 45 days of submission, unless the department finds it incomplete and requests revisions. Furthermore, institutions approved for a program can offer it via distance learning with just 30 days' notice to the department, and they must promptly report any probation or loss of accreditation to the regents. The bill also mandates that institutions with accreditation issues remain under departmental review until they have a sustained period of good standing, and requires notification to the department for any "substantive change" in a program, as defined by accrediting agencies. Finally, the commissioner will create a public database to track the status of program approval requests.
