This bill updates Florida's residential swimming pool safety requirements by mandating that any residential swimming pool located on property transferred or sold on or after October 1, 2025, must be equipped with at least one safety feature, such as an enclosure meeting specific barrier requirements, a safety pool cover, exit alarms, self-closing doors, or a swimming pool alarm. The bill requires title companies, inspectors, or mortgage underwriters to report violations of these safety requirements to local law enforcement agencies. Pool owners who fail to comply with these safety features may be charged with a misdemeanor of the second degree, though they can avoid penalties by installing a required safety feature within 45 days and attending a drowning prevention education program. The bill specifies detailed barrier requirements, including that barriers must be at least 4 feet high, have no gaps or openings that a child could penetrate, and be positioned to prevent immediate water access. The drowning prevention education program, to be developed by the department, can charge up to $100 for attendance and will be funded through fees, state appropriations, and grants. The new requirements will take effect on July 1, 2025, giving property owners and real estate professionals time to prepare for the changes.
