Bill Summary

AN ACT relating to the authority of a property owners' association to regulate the assembly, association, and speech of property owners or residents.

AI Summary

This bill adds a new section to the Texas Property Code that limits the ability of property owners' associations (HOAs) to restrict the assembly, association, and speech of property owners or residents. Specifically, the bill prohibits HOAs from adopting rules that prevent property owners from peacefully meeting with other members, residents, or guests in common areas, or from inviting guest speakers (including public officials and political candidates) without prior approval. The bill also prevents HOAs from regulating the content of property owners' speech. However, the bill does allow HOAs to still prohibit speech or conduct that threatens public health or safety, violates the law, or contains patently offensive language or displays, in accordance with state and federal constitutional protections. The new provisions will take effect on September 1, 2025, giving HOAs time to adjust their existing policies and dedicatory instruments to comply with the new restrictions on regulating residents' assemblies and speech.
