Bill Summary
Secure storage of firearms; penalties. Creates a Class 4 misdemeanor for any person who fails to securely store a firearm on any premises where such person knows, or reasonably should know, that a minor or a person who is prohibited by law from possessing a firearm is, or is likely to be, present. The bill increases the penalty to a Class 1 misdemeanor if a minor or a person who is prohibited by law from possessing a firearm obtains such firearm. The bill includes certain exceptions and requires firearms dealers to post a notice stating firearm storage requirements and the penalty for improperly storing such firearms. The bill also creates a Class 4 misdemeanor for any person who fails to report to law enforcement the theft or loss of a firearm from a vehicle and a Class 1 misdemeanor if another person obtains such firearm. Finally, the bill requires the Superintendent of State Police, in conjunction with the Commissioner of Health, to create a public awareness campaign on the importance of the secure storage of firearms by January 1, 2026.
AI Summary
This bill introduces new regulations for firearm storage in Virginia, focusing on preventing access by minors and prohibited persons. The bill creates three new sections in the state code that establish penalties for improper firearm storage. First, it requires gun owners to store firearms and ammunition in locked containers when minors or legally prohibited individuals are present, with violations resulting in a Class 4 misdemeanor. For unattended vehicles, the bill mandates that handguns must be stored in locked, opaque, hard-sided containers that are not visible from outside the vehicle and are affixed to the interior. Failure to report a firearm theft from a vehicle is a Class 4 misdemeanor, which escalates to a Class 1 misdemeanor if another person obtains the firearm. Additionally, the bill requires firearms dealers to post notices about storage requirements, and mandates that the Superintendent of State Police and Commissioner of Health develop a public awareness campaign about secure firearm storage by January 1, 2026. The campaign will provide resources on firearm safety, storage laws, safety devices, and risks associated with firearm access in homes. The bill includes exceptions for carrying firearms and does not prevent lawful authorization of minor firearm access under existing law.
