If an insurer fails to conduct the required inspection or transmit the estimate within these timeframes, they waive their right to inspect the vehicle before repairs, and claim negotiations will be limited to labor costs and parts pricing. The bill also empowers the Division of Insurance to impose administrative fines up to $1,200 or the actual damages for violations. Importantly, the bill defines "inspection" broadly to include both physical and digital inspections, such as digital photographs or videos through an authorized electronic system, providing flexibility for insurers while protecting consumer interests.
