This bill modifies existing public health law regarding home care worker wage parity by requiring an important change in financial documentation for home care service providers. Specifically, when government agencies make payments to certified home health agencies, licensed home care services agencies, long-term home health care programs, managed care plans, and fiscal intermediaries, these organizations must now provide an annual statement of wage parity hours and expenses accompanied by an independent accountant's report applying agreed-upon procedures, instead of the previously required independently-audited financial statement. The bill mandates that these organizations must certify they are in full compliance with wage and benefit requirements, and that no funds designated for home care aide wages will be returned to the agency or related entities. Contracts between different home care service providers must now include provisions requiring written verification of compliance and retention of these documents for at least ten years. Providers who knowingly submit false statements can be charged with perjury. The changes aim to increase transparency and accountability in home care worker compensation, ensuring that funds intended for worker wages are used appropriately.
