This bill amends the Social Services Law to expand eligibility for public assistance programs like Temporary Assistance to Needy Families (TANF), safety net assistance, and medical assistance for certain noncitizens. Specifically, the bill adds a new category of noncitizens who entered the United States within the previous five years who are either confirmed victims of human trafficking or have provided a sworn statement about being a victim of trafficking or domestic violence, along with corroborating evidence. These individuals and their spouse and unmarried children under 21 can receive benefits while their immigration-related petition or application is pending. For those who have filed an immigration relief petition, benefits will be available for the duration of the pending application, with administering entities required to request confirmation of pending status if the application remains unresolved after two years. For those who have not yet filed, benefits will be available for up to two years and will discontinue if there is a final administrative denial of their immigration-related petition. This expansion aims to provide temporary support and assistance to vulnerable noncitizen populations who are seeking legal status in the United States due to trafficking or violence.
