AI Summary
This bill establishes a comprehensive regulatory framework for kratom products in Nevada, requiring manufacturers and sellers to register each kratom product with the Division of Public and Behavioral Health before selling to end users. Specifically, the bill mandates that kratom product registrants submit an application, pay a fee, provide a certificate of analysis from an independent laboratory, and include detailed information about the product's composition and safety. The bill redefines kratom products as food containing parts of the Mitragyna Speciosa plant and sets strict requirements for product labeling, including serving size recommendations and usage directions. Additionally, the bill prohibits selling kratom products that are adulterated, contain high levels of certain alkaloids, or include synthetic compounds. The legislation provides protections for kratom product sellers if mitragynine is added to controlled substance schedules and establishes administrative fines for violations, replacing previous civil penalty provisions. The bill also appropriates funds to the Division to implement these new regulations and sets a January 1, 2024 implementation date, with some provisions taking effect immediately for preparatory administrative tasks.
