This bill establishes a new mechanism for enforcing state law and constitutional compliance among Wyoming's local governments (counties, cities, and towns). Under the legislation, one or more state legislators can request that the Attorney General investigate an alleged violation of state law or the Wyoming constitution by a local government's official action. If the Attorney General finds a violation, they must notify the local government and give them 30 days to resolve the issue. Should the local government fail to address the violation, the Attorney General will instruct the state treasurer to withhold undistributed state revenues from that jurisdiction. Before initiating an investigation, the legislator must first provide a written notification to the local government's leadership, giving them 60 days to resolve the issue voluntarily. The bill specifies that these enforcement procedures are the exclusive remedy for such violations, though they do not prevent other potential legal actions. Importantly, the state treasurer is prohibited from withholding funds that would be necessary for the local government to make debt service payments on pre-existing bonds or long-term obligations. The bill becomes effective on July 1, 2025, and aims to create a structured process for ensuring local governments adhere to state laws and constitutional requirements.
