This bill modifies Florida's existing laws regarding the sale and distribution of prescription hearing aids through the mail, which were previously completely prohibited. Under the new legislation, consumers can now receive prescription hearing aids via mail, but only if specific professional testing requirements are first met. Specifically, before a hearing aid can be mailed, all required testing procedures must be conducted by either a licensed audiologist (a healthcare professional specializing in hearing and balance) or a licensed hearing aid specialist. The testing must be done according to established procedures outlined in sections 468.1225 or 484.0501 of Florida Statutes. If someone attempts to sell or distribute prescription hearing aids through the mail without following these testing requirements, they will still be committing a second-degree misdemeanor, which can be punishable under existing state law. The bill is set to take effect on July 1, 2025, providing time for professionals and businesses to adjust to the new regulations.
