Bill Summary

Commercial entity offering social media accounts; restricted hours for minors; civil liability. Provides that no commercial entity that offers social media accounts, as defined in the bill, shall knowingly or intentionally allow a minor to access his social media account during the hours of 12:00 a.m. to 6:00 a.m. unless the minor's parent, guardian, or legal custodian has provided permission for the minor to use such social media account during these hours. The bill provides that any commercial entity that violates these provisions shall be subject to civil liability for damages resulting from the interference with a minor's sleep cycle or mental health by allowing such minor to access to his social media account during the hours of 12:00 a.m. to 6:00 a.m. and reasonable attorney fees and costs.

AI Summary

This bill introduces a new law that restricts minors' access to social media accounts during late night and early morning hours (12:00 a.m. to 6:00 a.m.). The bill defines a "social media account" as an online personal account that allows users to create profiles, share content, and interact with other users' content. Commercial entities offering social media accounts would be prohibited from allowing minors to access their accounts during these restricted hours, unless the minor's parent, guardian, or legal custodian has provided explicit permission. The time of access would be determined by the location of the Internet Protocol (IP) address used by the minor. If a commercial entity violates these provisions, they could be held civilly liable for damages related to interference with a minor's sleep cycle or mental health, and would also be responsible for reasonable attorney fees and costs. Importantly, the bill includes a clause explicitly stating that it does not impose liability on internet service providers or users. The intent of the bill appears to be protecting minors from potential negative impacts of late-night social media use on their sleep and mental well-being.
