This bill amends the New York Penal Law by adding a new provision that criminalizes non-consensual interference with sexually protective devices during sexual activity. Specifically, the bill defines three scenarios as criminal acts: (1) intentionally and without consent removing or tampering with a sexually protective device during sexual intercourse, oral sexual conduct, or anal sexual conduct in a way that makes the device ineffective; (2) intentionally using a sexually protective device that the person knows has been tampered with; and (3) intentionally misleading the sexual partner about the use or operability of a sexually protective device. The bill defines "sexually protective device" broadly to include items like condoms, spermicide, diaphragms, cervical caps, contraceptive sponges, dental dams, and other physical devices intended to prevent pregnancy or sexually transmitted infections. This legislation aims to protect individuals from deceptive sexual practices that could potentially expose them to unwanted pregnancy or sexually transmitted infections without their informed consent. The bill is set to take effect on the first of November following its enactment.
